These Terms of Service ("Terms") govern your access to and use of the website operated by mhurleyinc Custom Cabinetry ("mhurleyinc," "we," "us," or "our") at https://mhurleyinc.make-this-yours.comand related online services (collectively, the "Services").

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

mhurleyinc is a custom cabinetry and architectural millwork studio. Information on the Services is provided for general informational purposes and to help prospective clients learn about our work and contact us.

You agree to use the Services only for lawful purposes. You may not:

• Attempt to interfere with or disrupt the Services or related systems
• Use the Services to send spam, malware, or abusive content
• Scrape, harvest, or copy content except as allowed by applicable law
• Misrepresent your identity or affiliation when contacting us

Submitting a contact form or inquiry does not create a contract for design, fabrication, or installation. Any project engagement is subject to a separate written agreement, quote, or purchase order that we and you expressly accept. Descriptions, images, and examples on the Services do not constitute an offer, warranty, or guarantee of availability, pricing, or outcome.

Unless otherwise noted, all content on the Services, including text, images, graphics, logos, photographs, and layout, is owned by mhurleyinc or our licensors and is protected by copyright, trademark, and other laws. You may view and share pages for personal, non-commercial reference. You may not copy, modify, distribute, or create derivative works from our content without prior written permission, except as permitted by law.

If you send us information, files, or messages through the Services, you represent that you have the right to share that material and that it does not violate any law or third-party rights. You grant us a non-exclusive license to use that material as needed to respond to you and evaluate a potential project.

The Services may include links to third-party websites. We do not control and are not responsible for those sites or their content, policies, or practices.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, MHURLEYINC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

These limitations do not affect rights you may have under a separate written project agreement.

You agree to indemnify and hold harmless mhurleyincand its owners, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your submissions, or your violation of these Terms.

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Courts located in Hennepin County, Minnesota will have exclusive jurisdiction over disputes arising from these Terms or the Services, except where prohibited by law.

We may update these Terms from time to time. The effective date at the top of this page will be revised when changes are posted. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
